FITNESS & HEALTH ACKNOWLEDGEMENT

1. MEDICAL DISCLAIMER

Taikan is a fitness management platform that provides tools for scheduling, workout tracking, and programming delivery. Taikan does not provide medical advice, diagnosis, or treatment. Nothing contained in this platform, or in any content delivered through it, constitutes medical advice.

Before beginning any exercise program, you should consult a qualified physician or other licensed healthcare provider, particularly if you have or suspect you may have any of the following: heart disease, high blood pressure, diabetes, joint or bone problems, pregnancy, respiratory conditions, or any other health condition that may be affected by physical activity.

2. ACKNOWLEDGEMENT OF INHERENT RISK

Physical exercise involves inherent risks, including muscle strains and sprains, joint injuries, cardiovascular events, falls and other accidental injuries. By participating, you acknowledge those inherent risks and agree to follow the Organization's safety instructions, use equipment only as instructed and stop exercising if you experience a concerning symptom.

You are responsible for providing accurate health information and for obtaining medical advice or clearance when required. This acknowledgement does not transfer to you a risk created by another person's negligence, intentional act or breach of a legal duty.

3. NO WAIVER OF MANDATORY RIGHTS

Nothing in this acknowledgement releases or limits Taikan, an Organization, a trainer, a payment provider or any other person from liability for bodily injury, negligence, an intentional act, breach of a statutory safety duty or any other liability that cannot lawfully be excluded or limited. Your consumer, privacy and other mandatory rights remain in full force.

4. INDEPENDENT TRAINERS AND FITNESS ORGANIZATIONS

Taikan provides software tools to independent fitness businesses and trainers ("Organizations"). An Organization is not Taikan's employee or agent and is responsible for its premises, equipment, staff, exercise instruction, supervision and compliance as the fitness-service provider.

Taikan remains responsible for the parts of the Platform under its control and for obligations imposed on Taikan by law. Using Taikan does not make either party responsible for the other's independent acts.

5. HEALTH DECLARATIONS AND MEDICAL CERTIFICATES

Where the Fitness Institutes (Licensing and Supervision) Law or another law applies, the Organization may require the prescribed health questionnaire and declaration, a medical certificate and, for a minor, parental consent before participation. The Organization is responsible for determining, reviewing and enforcing those requirements. If a declaration or certificate is submitted through Taikan, Taikan processes it on the Organization's instructions as described in the Privacy Policy and in the notice shown on the form.

6. MINORS

A person under 18 may participate only with the consent of a parent or legal guardian and subject to the age, health and supervision requirements imposed by law and by the Organization. A person accepting this acknowledgement for a minor confirms that they are authorized to do so. This acknowledgement is not a substitute for any prescribed parental-consent or health form.

7. GOVERNING LAW

This acknowledgement is governed by Israeli law. A dispute may be brought before a court that has jurisdiction under applicable law; this acknowledgement does not restrict a consumer's mandatory venue rights.
